1 Definitions

• "Proplisto", "Platform", "we", "us" — refers to proplisto.com, operated by AK Landmarks LLP, registered in Bengaluru, Karnataka, India.
• "User", "you" — any individual, company, or entity that accesses or uses the Platform.
• "Services" — all features including property listings, comparison tools, developer profiles, enquiry submissions, site visit bookings, and informational content.
• "Content" — all text, images, videos, data, floor plans, pricing, maps, and materials on the Platform.
• "Developer" — any real estate developer or builder whose projects are listed on the Platform.
• "Property Listing" — any residential or commercial property displayed on the Platform.
• "Personal Information" — any information that identifies a User, including name, email, phone number, and location.

2 Acceptance of Terms

By accessing or using Proplisto, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions along with our Privacy Policy. These Terms form a legally binding agreement between you and AK Landmarks LLP

If you do not agree with any part of these Terms, you must discontinue using the Platform immediately. Continued use after modifications constitutes acceptance of updated Terms.

3 Eligibility

To use the Services provided by Proplisto, you must:

• Be at least 18 years of age and legally competent to enter into a binding agreement under the Indian Contract Act, 1872.
• Provide accurate, truthful, and complete information when submitting any form on the Platform.
• Not be barred from receiving services under the laws of India.

If using the Platform on behalf of a company or entity, you represent that you are authorized to bind such entity to these Terms.

4 Account Registration & Security

Certain features may require you to submit contact information. You agree to:

• Provide accurate, current, and complete information.
• Maintain confidentiality and security of your account credentials.
• Accept responsibility for all activities under your account.
• Notify Proplisto immediately of any unauthorized access or security breach.

Proplisto reserves the right to suspend or terminate accounts at any time for suspected inaccurate, incomplete, or fraudulent activity.

5 Services Provided

Proplisto provides the following Services:

• Property Listings: Browse verified residential and commercial properties — apartments, villas, plots, row houses, villaments, managed farmlands, and commercial spaces across Bangalore, Mumbai, Chennai, Hyderabad, Delhi, Kolkata, Indore, and Kochi.
• Property Comparison: Compare up to 4 properties side-by-side on pricing, amenities, RERA status, possession dates, and 12+ data points.
• Developer Profiles: Access verified developer portfolios with active/completed projects and company details.
• Enquiry & Site Visits: Submit enquiries and request free site visits. Our consultants coordinate further assistance.
• Informational Content: Access real estate guides, market insights, locality information, and price trends.

6 User Obligations & Conduct

As a User of Proplisto, you agree not to:

• Use the Platform for any unlawful, fraudulent, or malicious purpose.
• Post defamatory, obscene, threatening, or objectionable content.
• Impersonate any person or entity.
• Use automated systems, bots, scrapers, or spiders to access or extract data without written consent.
• Attempt unauthorized access to the Platform's servers, databases, or systems.
• Interfere with the integrity, security, or performance of the Platform.
• Transmit viruses, malware, or harmful code.
• Use contact information obtained through the Platform for spamming or unsolicited marketing.
• Copy, reproduce, or create derivative works from Platform Content without permission.
• Harvest or store personal data of other Users.

7 Property Listings & Information

You acknowledge and agree that:

• Property information — pricing, availability, floor plans, amenities, specifications, RERA numbers, possession dates, and images — is provided by the respective Developers.
• Proplisto does not independently verify every listing detail and does not guarantee accuracy, completeness, or timeliness.
• Prices are indicative and subject to change. Verify all pricing directly with the Developer.
• Images and renders are for illustrative purposes and may not represent the finished product.
• RERA numbers are as provided by Developers. Verify independently on the Karnataka RERA portal (rera.karnataka.gov.in) or your state RERA authority.
• Proplisto does not endorse, recommend, or guarantee any property, developer, or investment outcome.

8 No Brokerage & Free Platform Policy

Proplisto is free-to-use for property seekers. We do not charge brokerage, commission, or fees for browsing, comparing, or submitting enquiries.

Any transaction between a User and a Developer is solely between those parties. Proplisto bears no responsibility for disputes, losses, or claims arising from such transactions.

9 Intellectual Property

All Content — including the Proplisto name, logo, design, UI, text, graphics, images, software, and source code — is the exclusive property of AK Landmarks LLP and is protected under the Copyright Act 1957, Trade Marks Act 1999, and applicable international treaties.

You are granted a limited, non-exclusive, revocable licence for personal, non-commercial use. You shall not:

• Copy, modify, reproduce, distribute, or transmit any Content without written consent.
• Use the Proplisto brand name, logo, or trademarks in any misleading manner.
• Decompile, reverse-engineer, or disassemble any Platform software.
• Frame, mirror, or use meta tags with Proplisto's name without permission.

10 Privacy & Data Protection

Your Personal Information is governed by our Privacy Policy. By using the Platform, you consent to:

• Collection of information you provide through enquiry forms, contact forms, and site visit requests.
• Use of cookies, Google Analytics, and similar technologies for usage analytics and improvement.
• Sharing your contact information with relevant Developers or consultants to facilitate property enquiries. We do not sell personal data to third parties.
• Reasonable security measures to protect your data — though no electronic method is 100% secure.

11 Third-Party Links & Services

The Platform may contain links to third-party websites including Google Maps, YouTube, developer websites, and social media platforms. Proplisto does not endorse and is not responsible for third-party content, privacy policies, or practices. Interaction with third-party services is at your own risk.

12 Disclaimer of Warranties

The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, including:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the Platform will be uninterrupted, error-free, or secure.
• Warranties regarding accuracy or timeliness of any property listing, pricing, or developer information.

13 Limitation of Liability

To the maximum extent permitted by law, Proplisto shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages from use of the Platform.
• Loss of profits, revenue, data, business opportunities, or goodwill.
• Damages from reliance on property details, pricing, RERA status, or developer claims.
• Disputes between Users and Developers or any third party.
• Unauthorized access to or alteration of your data.

Total aggregate liability shall not exceed INR 10,000.

14 Indemnification

You agree to defend, indemnify, and hold harmless Proplisto and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of or access to the Platform.
• Your violation of these Terms or applicable law.
• Your violation of third-party rights (intellectual property, privacy, etc.).
• Any content or information you submit through the Platform.

15 Termination

Proplisto may suspend or terminate your access at any time, without notice, for breach of Terms, suspected fraud, law enforcement requests, or extended inactivity.

Upon termination, provisions regarding IP, disclaimers, liability limitations, and indemnification shall survive.

16 Modifications to Terms

Proplisto may modify these Terms at any time. Changes take effect immediately upon posting with an updated "Last Updated" date. Continued use constitutes acceptance.

17 Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
